1. Overview

Welcome to Modelier Timepieces.

These Terms of Service (“Terms”) govern your access to and use of modelierwatches.com, including purchases made through our online store and any related services provided by Modelier Timepieces (collectively, the “Services”).

The terms “Modelier Timepieces”, “we”, “us” and “our” refer to:

By accessing our website or placing an order, you agree to these Terms together with any policies referenced in them, including our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms is intended to exclude, restrict or reduce any mandatory consumer rights available to you under applicable Greek or European Union law.


2. Eligibility and Use of the Store

You must have the legal capacity required under the law applicable to you to enter into a purchase contract.

You agree to provide accurate, current and complete information when placing an order or creating an account.

If you create a customer account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.

You may not use our Services for any unlawful or fraudulent purpose or in a manner that infringes the rights of Modelier Timepieces or any third party.


3. Our Products

Modelier Timepieces specialises in custom-built and modified timepieces assembled using selected components.

Our products may incorporate movements or components manufactured by third parties. Unless expressly stated otherwise, Modelier Timepieces is an independent business and is not affiliated with, authorised by, endorsed by or officially connected with Seiko®, Rolex®, Omega® or any other watch manufacturer whose trademarks may be referenced for descriptive or compatibility purposes.

Product photographs and visual representations are prepared as accurately as reasonably possible. However, colours, reflections, finishes and other visual details may appear slightly different depending on lighting, photography and the display settings of your device.

Because many Modelier timepieces are assembled to order, minor differences resulting from assembly or component manufacturing tolerances may occur, provided that they do not materially alter the product ordered.

Product specifications, components and availability may change from time to time. We will not make a material substitution affecting the essential characteristics of an existing customer order without appropriate communication with the customer.


4. Custom and Personalised Products

Certain Modelier products may be created according to a customer's individual specifications or personalised through services such as engraving.

It is your responsibility to ensure that any names, initials, dates, wording, symbols, measurements or other personalisation details submitted to us are correct.

Once production or personalisation has begun, changes may not always be possible.

Products that are made specifically to your individual specifications or clearly personalised may be excluded from statutory change-of-mind withdrawal rights where applicable law permits such an exception.

This does not affect your statutory rights where a product is defective, damaged, incorrectly supplied or otherwise does not conform to the contract.

5. Orders and Contract Formation

By submitting an order through our store, you are making an offer to purchase the selected products.

After your order is placed, you will normally receive an electronic acknowledgement or order confirmation.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of:

  • suspected fraud or unauthorised payment
  • payment failure
  • obvious pricing or product information errors
  • component or product unavailability
  • inability to fulfil the order
  • suspected misuse of the website
  • legal or regulatory restrictions

If we cancel an order after payment has been successfully collected, the relevant amount will be refunded to the original payment method in accordance with applicable law.

We may contact you using the email address or telephone number provided with your order if clarification is required.


6. Prices, Taxes and Payment

Prices are displayed in the currency indicated on the website.

Applicable taxes are included or applied as required by law and as indicated during the checkout process.

Shipping charges, where applicable, will be displayed during checkout before you complete your purchase.

Orders delivered outside the European Union may be subject to customs duties, import taxes or other charges imposed by the destination country. Unless otherwise stated, such charges are the responsibility of the recipient and are not controlled by Modelier Timepieces.

Payments are processed through Shopify and/or authorised third-party payment providers.

You represent that you are authorised to use the payment method submitted with your order.

We do not generally receive or store your complete payment card details. Payment information is processed by the relevant payment provider in accordance with its applicable terms and privacy practices.


7. Order Processing and Quality Control

Orders are prepared in accordance with our current processing procedures.

Each Modelier timepiece is subject to preparation, assembly and quality-control checks before being approved for shipment.

Our current estimated processing and delivery information is provided in our Shipping Policy and, where applicable, on the relevant product page.

Processing and delivery estimates may change during periods of unusually high order volume, component shortages or circumstances outside our reasonable control.

Where a significant delay affects your order, we will make reasonable efforts to inform you.


8. Shipping and Delivery

We ship orders using third-party courier and delivery providers.

Delivery dates and timeframes displayed on our website or communicated to you are estimates unless expressly stated otherwise.

Courier delays, customs procedures, adverse weather, strikes, transportation disruption or other circumstances outside our reasonable control may affect delivery.

You are responsible for providing a complete and accurate delivery address.

For consumer sales where Modelier Timepieces arranges the carrier, the risk of loss of or damage to the goods generally remains with us until you, or a third party designated by you other than the carrier, acquire physical possession of the goods.

Where you independently commission a carrier not offered by Modelier Timepieces, different rules regarding the passing of risk may apply in accordance with applicable law.

This provision does not limit any mandatory consumer protection rights.

9. Returns and Right of Withdrawal

Modelier Timepieces provides a 30-day voluntary return policy for eligible products, subject to the conditions described in our Refund Policy.

For consumers in the European Union, this voluntary policy operates in addition to statutory consumer rights, including the applicable 14-day right of withdrawal for eligible distance purchases.

Certain statutory exceptions may apply, including for goods made to a consumer's individual specifications or clearly personalised.

The conditions, procedure, return-shipping responsibilities, exclusions and refund process are explained in our Refund Policy.

Nothing in these Terms reduces any mandatory right you may have under applicable consumer law.


10. Refunds

Approved refunds will normally be returned to the original payment method.

Refund processing times may depend on the payment provider or financial institution.

Where a consumer exercises a statutory EU right of withdrawal, reimbursement will be handled in accordance with applicable law, including any obligation to reimburse standard delivery charges.

Where permitted by law, reimbursement may be withheld until we have received the returned goods or the customer has supplied evidence that they have sent them back, whichever occurs first.

11. Warranty and Statutory Consumer Rights

Modelier Timepieces currently provides a 1-year limited commercial warranty, subject to the terms of our Warranty Policy.

This commercial warranty is an additional benefit and does not replace, restrict or reduce statutory consumer rights.

Consumers purchasing goods within the European Union benefit from the applicable legal guarantee of conformity. Under EU rules, consumers are entitled to a minimum two-year legal guarantee for goods that are faulty or do not conform to the contract.

Where applicable, statutory remedies may include repair or replacement and, where the relevant legal conditions are satisfied, a price reduction or refund.

Our commercial warranty and statutory legal guarantee are separate rights.


12. Product Care and Improper Use

Mechanical and modified watches require appropriate care.

Customers should follow any care instructions supplied with the product or published on our website.

Damage resulting solely from circumstances such as misuse, accidents, impacts, unauthorised modifications, improper opening of the watch or other causes unrelated to a lack of conformity may not qualify for coverage under our commercial warranty.

Any commercial-warranty exclusions apply only to the extent permitted by law and do not exclude statutory rights relating to defective or non-conforming goods.


13. Intellectual Property

Unless otherwise stated, the content of the Modelier Timepieces website, including:

  • the Modelier Timepieces name and branding
  • logos
  • original product photography
  • graphics
  • text
  • videos
  • website design
  • original artwork and creative content

is owned by or licensed to Modelier Timepieces and is protected by applicable Greek, European Union and international intellectual-property laws.

You may use the website for personal and non-commercial purposes.

You may not reproduce, commercially exploit, republish, distribute, modify or otherwise use protected Modelier Timepieces content without our prior permission, except where such use is permitted by applicable law.

Third-party trademarks remain the property of their respective owners.

Use of a third-party trademark on our website does not imply affiliation, sponsorship or endorsement unless expressly stated.


14. Third-Party Services and Links

Our Services may include tools, payment services, links or functionality provided by third parties.

Those third parties may operate under their own terms and privacy policies.

We are not responsible for the independent content, privacy practices or operation of third-party websites or services that are outside our control.

Nothing in this section excludes responsibility that cannot lawfully be excluded.


15. Relationship with Shopify

Our online store is hosted and supported by Shopify.

Shopify provides the e-commerce infrastructure through which our website and checkout operate.

However, purchases made from Modelier Timepieces are transactions between the customer and Modelier Timepieces, not between the customer and Shopify.

Shopify may process certain information in connection with its platform and Services as further explained in our Privacy Policy and Shopify's own privacy documentation.


16. Privacy and Personal Information

Our collection and processing of personal information is governed by our Privacy Policy.

The Privacy Policy explains, among other matters:

17. Reviews, Feedback and User Content

If you voluntarily provide a review, photograph, testimonial, suggestion or other content to Modelier Timepieces, you confirm that you have the right to provide that content and that it does not unlawfully infringe another person's rights.

We may use feedback or content that you have expressly submitted for publication or promotional use where permitted by applicable law and subject to any required permissions.

We will not knowingly use customer content in a way that violates applicable privacy, copyright or consumer-protection laws.


18. Prohibited Uses

You must not use our website or Services to:

Nothing in this section allows us to disregard mandatory consumer rights.


20. Availability of the Website

We aim to keep our Services available and functioning correctly.

However, we cannot guarantee that the website will always operate without interruption, delay or technical error.

We may temporarily suspend or modify parts of the website for maintenance, security, updates or other reasonable operational purposes.


21. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits or excludes any mandatory rights or remedies available to consumers under applicable law.

To the extent permitted by applicable law, Modelier Timepieces will not be responsible for losses that:

  • were not reasonably foreseeable when the contract was entered into
  • result from circumstances outside our reasonable control
  • result from unlawful or improper use of the Services by the customer
  • relate to business or commercial losses where the customer is purchasing solely as a consumer

Any limitations in these Terms apply only to the maximum extent permitted by law.

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited.


22. Indemnification for Unlawful Use

To the extent permitted by applicable law, you may be responsible for losses or claims caused by your intentional unlawful misuse of our Services, infringement of third-party rights or material breach of these Terms.

This provision does not impose liability on consumers beyond what is permitted under applicable law.


23. Severability

If any provision of these Terms is determined by a competent authority to be unlawful, invalid or unenforceable, that provision will be applied or modified only to the extent necessary and the remaining provisions will continue in effect.


24. No Waiver

If we do not immediately exercise or enforce a right under these Terms, this does not mean that we have waived that right.


25. Governing Law and Jurisdiction

These Terms and contracts entered into with Modelier Timepieces are governed by the laws of Greece, subject to mandatory consumer-protection rules that may apply to you.

If you are a consumer residing in another country of the European Union or European Economic Area, this choice of law does not deprive you of mandatory consumer protections available under the laws that would otherwise apply to you.

Any dispute will be handled by the courts having jurisdiction under applicable law.

Nothing in these Terms prevents a consumer from bringing proceedings before a court where the consumer has a statutory right to do so.


26. Changes to These Terms

We may update these Terms from time to time to reflect changes in:

  • our Services
  • our business practices
  • applicable law or regulation
  • Shopify functionality
  • security or technical requirements

The current version will be published on our website together with the applicable “Last updated” date.

Changes will not retroactively remove mandatory rights that have already arisen under an existing consumer contract.
